Agatha – Life Stories LTD - (V 3/26)
These Terms of Service ("Terms") govern your access to and use of the Agatha platform, operated by Agatha – Life Stories LTD ("the Company", "Agatha", or "the Platform"). By using the Platform, you acknowledge that you have read, understood, and agreed to these Terms, including your responsibilities and indemnification obligations.
1. Beta Version Notice
The Platform is provided in a beta version. It is provided "as is" and "as available" without any express or implied warranty of any kind. The Company makes no guarantees regarding the accuracy, completeness, or suitability of any content or functionality. You acknowledge that your use of the platform may involve errors, omissions, or interruptions, and you accept all risks associated with such use.
2. User Content & Intellectual Property
2.1 Ownership: You retain all ownership rights to the personal stories, data, and media you upload ("User Content").
2.2 License to Agatha: By using the Platform, you grant Agatha a worldwide, royalty-free, and non-exclusive license to host, store, and process your content solely for the purpose of providing the service (generating and printing your book or other related services provided to you by the Company).
2.3 AI-Generated Content: You acknowledge that the content is generated using Artificial Intelligence. The Company shall not be liable for any discomfort, harm, or consequences resulting from the AI-generated output or your use of the platform.
3. Exclusivity & Printing Requirement
3.1 Mandatory Printing: By agreeing to these terms, you commit to act exclusively through the Platform and specifically to print any books generated or authored through Agatha exclusively through the Company’s authorized channels.
4. User Responsibilities & Conduct
4.1 Purpose of Use: The use of the platform is for reasonable use only for the purpose of writing a book and not for other purposes.
4.2 Content Responsibility: You are solely responsible for any content you create, upload, or share.
4.3 Legal Compliance: You must comply with all applicable laws, including copyright, defamation, and privacy requirements.
4.4 Prohibited Content: You undertake not to upload any content that is illegal, infringing, defamatory, or in violation of intellectual property laws or prohibitions against hate speech.
4.5 Termination: Agatha is authorized to terminate a customer's use of the platform at its sole discretion.
5. Limitation of Liability
5.1 General Limits: The Company, its affiliates, and officers are not liable for any direct, indirect, consequential, or incidental damages arising from your use of the platform.
5.2 Data Security: While the Company implements reasonable technical and organizational measures to protect your information, it cannot guarantee absolute security. The Company shall not be liable for any loss, corruption, or unauthorized access to your data.
5.3 Monetary Cap: To the maximum extent permitted by law, the Company's total liability for any security-related incident shall be limited to the amount paid by the User to the Company within the 12 months prior to the alleged breach.
6. Fees, Payments, and Refund Policy
6.1 Service Fees: Access to certain features of the Platform and the generation of books may require payment of fees as specified on the Platform. All fees are non-refundable except as expressly stated herein.
6.2 Digital Content: Once the AI generation process has commenced or the digital preview of the book has been delivered, no refunds will be issued for the digital service component, as the service is deemed "consumed".
6.3 Physical Books & Printing: Since books are custom-printed to your specific requirements through third-party partners, orders cannot be canceled or refunded once they have been sent to production.
6.4 Defects and Errors: In the event of a manufacturing defect or shipping damage, you must notify Agatha within 14 days of delivery with photographic evidence. Agatha, at its sole discretion, may offer a re-print or a partial credit.
6.5 Content Errors: Agatha is not responsible for typos, factual errors, or dissatisfaction with the AI-generated narrative style, as the User is solely responsible for reviewing and approving the content before printing.
7. Indemnification
You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the platform
